Litigation can be defined as the proceedings initiated between two opposing parties to enforce or defend a legal right. Litigation is not to be confused with a lawsuit. Litigation includes a number of activities before, during, and after a lawsuit is initiated to enforce a legal right. In addition to the actual lawsuit,  negotiation, arbitration, facilitation and appeals may also form a part of the litigation process.
